I refer to the letter dated 24th August, 1942, from Mr. R.S.R. to the Prime Minister.

For the purposes of the Defence Act ‘Australia’ is defined to include the Territories of the Commonwealth to which that Act extends.

‘Territories of the Commonwealth’ by virtue of paragraph (p) of section 17 of the Acts Interpretation Act 1901–1941 includes any Territory governed by the Commonwealth under a mandate.

With reference to your memorandum of 4th November, 1942, whilst the Commission has power to purchase meat by voluntary agreement at any price (see regulation 32(a)), in my opinion as soon as the sale is made compulsory placitum (xxxi) of section 51 of the Constitution applies, and just terms must be given.

I refer to your memorandum of 2nd July, 1942 (your 410/3/38) in which you ask for my opinion as to the significance of the judgment recently given by Judge O’Mara on the application under regulation 6 of the National Security (Industrial Peace) Regulations to have the Timber Workers’ Award declared a common rule.(1)

COMMONWEALTH POWERS (WAR) ACT 1915 (NSW): CONSTITUTION s 51(xxxvii)

The Adelaide Advertiser of December 18th published the text of an opinion by Mr. Ligertwood, K.C., that the Commonwealth Powers Bill 1942 as drafted at the recent Convention does not give legal effect to the intention that the reference should be limited in time nor to the intention that laws passed under the reference should cease to have full force and effect after the expiration of the five-year period; and that this is the result of the form in which the Bill is drawn.
